Bonewick Terms of Service

1. Agreement

These Terms of Service (the "Terms") are a legal agreement between you and 4 Birds Studios LLC ("4 Birds Studios," "we," "us") for the Bonewick mobile game, including its updates, content, leaderboard, and related services (the "Game"). By downloading, installing, or playing the Game, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.

The Game is offered through the Apple App Store and Google Play. The platform-specific terms for Apple and Google near the end of these Terms apply in addition to everything else here.

2. Who may play

The Game is for players of all ages. Anyone can play as a guest. Players 13 and older may choose to sign in to the Game with an Apple or Google account, and players under 13 always play as guests. If you are under 18 (or under the age of majority where you live), you may use the Game only with the involvement of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use of the Game. When the Game asks for your age, you agree to answer honestly. The Game gives younger players extra protections, described in our Privacy Policy. You must not be barred from using the Game under applicable law.

3. Your account

Signing in is optional. To sign in, you must be 13 or older and use a valid Apple or Google account. Guests do not have an account, and their progress may be lost if they uninstall the Game or reset their device. You agree to keep your sign-in secure, to tell us if you think someone has used your account without permission, and to follow these Terms. You are responsible for activity on your account. Your account is for you only: do not share it, sell it, or transfer it. We may suspend or end an account that breaks these Terms or that we reasonably believe is being misused.

You can delete your account, or your guest data, at any time in the Game (Settings → Account → Delete account) or by following the steps at our account-deletion page. Deleting your account permanently removes your progress, nickname, and leaderboard entries, as described in our Privacy Policy.

4. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and play the Game on devices you own or control, for your personal, non-commercial entertainment, in accordance with the usage rules of the Apple App Store or Google Play where you obtained it. The Game is licensed, not sold.

5. Rules of play

You agree not to:

• copy, modify, distribute, sell, rent, or lease the Game or any part of it;
• reverse engineer, decompile, or extract source code or assets from the Game, except where the law expressly allows it;
• cheat, use bots, scripts, or hacks, exploit bugs, submit false scores, or tamper with the Game, its data, or its security;
• share, sell, or transfer your account, or use someone else's account without permission;
• click or tap on ads artificially, or encourage others to, or otherwise interfere with the Game's ads or advertising systems;
• use the Game in violation of any law, or to harm, harass, or defraud others; or
• remove or hide any copyright, trademark, or other notice in the Game.

6. Leaderboard and nicknames

The Game has a public leaderboard. Your nickname (or the name the Game gives you), your scores, and your ranking are visible to other players. Players 13 and older may choose a nickname. Younger players are given a generated name.

You agree that your nickname will not:

• be offensive, hateful, sexual, violent, or harassing, or promote illegal activity;
• include your real name, other people's names, contact details, addresses, schools, social-media handles, or any other personal information;
• impersonate another person or 4 Birds Studios, or mislead others; or
• infringe anyone's rights, including trademarks.

Moderation and reporting. Nicknames are screened by a filter, but filters are not perfect. You can report an inappropriate nickname from the leaderboard or by emailing support@4birdstudiosllc.com. We review reports and will act on them within a reasonable time. We may remove, change, or reset any nickname, score, or leaderboard entry, and may restrict leaderboard access for players who break these Terms or cheat, at our discretion and without notice. You grant us a free, worldwide license to store and display your nickname and scores in the Game for the purpose of running the leaderboard.

7. Ownership

The Game, including its code, artwork, characters, names, music, sounds, and the "Bonewick" and "4 Birds Studios" names and logos, is owned by 4 Birds Studios or its licensors and is protected by copyright, trademark, and other laws. These Terms give you no ownership rights. All rights not expressly granted are reserved.

8. Advertising and third-party services

The Game is supported by advertising and shows ads from third parties through Google AdMob, and it uses Supabase to run the leaderboard. We do not control advertisers or the content of their ads, and any dealings between you and an advertiser are solely between you and them. Details about how ads and the leaderboard use information are in our Privacy Policy.

9. Purchases and virtual items

If the Game offers optional in-app purchases (for example, removing ads), they are processed by Apple or Google under their terms and payment methods. Prices are shown in the store before you buy. Refunds are handled by Apple or Google according to their policies; we cannot issue refunds for store purchases. Any virtual items or currency have no cash value, are not transferable, and are licensed to you, not owned. Children should not make purchases without a parent's permission.

10. Updates and availability

We may update, change, suspend, or discontinue the Game, the leaderboard, or any feature at any time. Some updates may be required to keep playing. The Game needs an internet connection for ads and the leaderboard, and your carrier's data charges may apply.

11. Feedback

If you send us suggestions or feedback, you grant us a free, perpetual license to use them without obligation to you.

12. Termination

You may stop using the Game at any time by uninstalling it, and you may delete your account as described above. We may suspend or end your license if you break these Terms. When your license ends, you must stop using the Game and delete it from your devices. Sections that by their nature should survive, including ownership, disclaimers, limits of liability, and governing law, will survive.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Game is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Game or the leaderboard will be uninterrupted, error-free, or free of harmful components, that rankings will be accurate, or that the Game will work on every device. Some places do not allow these exclusions, so they may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, 4 Birds Studios and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or goodwill, arising from or related to the Game or these Terms. Our total liability for all claims relating to the Game will not exceed the greater of the amount you paid us for the Game in the 12 months before the claim or US$50. Nothing in these Terms limits liability that cannot be limited by law, and your statutory consumer rights are not affected.

15. Your responsibility

To the extent permitted by law, you (and, for a child, the parent or guardian who allowed the child to use the Game) agree to be responsible for third-party claims, losses, and reasonable costs that arise from a breach of these Terms or misuse of the Game.

16. Platform-specific terms (Apple and Google)

A. If you got the Game from the Apple App Store (iPhone and iPad)

1. Acknowledgement. These Terms are between you and 4 Birds Studios only, not Apple Inc. ("Apple"). 4 Birds Studios, not Apple, is solely responsible for the Game and its content. These Terms may not give you usage rights that are broader than the usage rules set out in Apple's Apple Media Services Terms and Conditions.
2. Scope of license. Your license is a non-transferable license to use the Game on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
3. Maintenance and support. 4 Birds Studios, not Apple, is solely responsible for providing any maintenance and support for the Game. Apple has no obligation to provide any maintenance or support. Support is available at support@4birdstudiosllc.com.
4. Warranty. 4 Birds Studios is solely responsible for any product warranties. If the Game fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the Game to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
5. Product claims. 4 Birds Studios, not Apple, is responsible for addressing any claims by you or any third party relating to the Game or your possession or use of it, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
6. Intellectual property rights. If a third party claims that the Game or your use of it infringes that party's intellectual property rights, 4 Birds Studios, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of the claim.
7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
8. Developer name and address. Questions, complaints, or claims about the Game may be directed to 4 Birds Studios LLC, 15807 W. Woodlands, Goodyear, AZ 85338, United States, support@4birdstudiosllc.com.
9. Third-party terms. You must comply with any applicable third-party terms (for example, your wireless data service agreement) when using the Game.
10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

B. If you got the Game from Google Play (Android)

1. Google Play terms. Your download and use of the Game is also subject to the Google Play Terms of Service and Google's usage rules. If these Terms conflict with them as to Google Play's services, Google's terms control for those services.
2. Google is not a party. These Terms are between you and 4 Birds Studios. Google LLC and its affiliates are not responsible for the Game, its content, maintenance, or support, or for any claims about it.
3. Support and refunds. 4 Birds Studios provides support for the Game at support@4birdstudiosllc.com. Refund requests for purchases made through Google Play are handled under Google Play's refund policy.
4. Permissions. The Game requests only the permissions it needs to run, show ads, and load the leaderboard, as described in our Privacy Policy.

17. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-laws rules. You and we agree that any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. If you are a consumer in the European Economic Area, the United Kingdom, or another place whose mandatory consumer laws give you rights to sue or be sued in your home courts or to rely on your local law, those rights are not affected.

18. Changes to these Terms

We may update these Terms from time to time. We will post the new version here with an updated date, and where required, we will notify you in the Game or ask you to accept the updated Terms. If you keep using the Game after an update, you accept the new Terms.

19. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Game. If a part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
